About us

Hippischadvocaat.nl is a subsidiary of Fermm B.V., a law firm established in Amsterdam, the Netherlands. Fermm B.V. and Fermm Coöperatief Utrecht U.A., established in Utrecht, jointly comprise a strategic alliance (“Fermm”). Both entities operate independently and are not liable for each other’s actions. Similarly, entities do not assume joint liability in relation to the European General Data Protection Regulation (“GDPR”). Nevertheless, both entities have agreed to abide by the terms set forth in this comprehensive Privacy Statement.

Our Privacy Policy

Our Privacy Policy was last updated on February 1, 2021. We reserve the right to unilaterally alter or supplement our Privacy Policy by updating this web page. For this reason, you are advised to regularly consult this web page. When substantial alterations are made to this Privacy Policy, clear notice will be given through the joint website www.fermm.nl.

In this Privacy Policy we explain:

  • what personal data will be collected and in what manner collection will take place;
  • for which purposes and reasons we process your personal data;
  • how long we store your personal data for;
  • with whom we share your personal data;
  • how your personal data will be protected;

Personal data

Personal data are defined as all information pertaining to an identified or identifiable physical person. We are able to process, inter alia, the following personal data items:

  • common data items such as your first and last name, title;
  • contact details such as your email address, postal address, and telephone number;
  • data concerning the device you used to access our website, such as the IP address;

We collect your personal data functionally because you have provided us with them. We are also able to obtain personal data from other sources, such as other law firms, counterparties, the Commercial Registry, the Land Registry, or by utilizing other public data sources.

Purposes and grounds for the processing of personal data

Fermm may use your personal data for the following purposes:

  • for providing our legal services;
  • to comply with our statutory obligations;
  • for marketing and business development activities such as the distribution of newsletters, invitations to our events, and other marketing materials that may interest you;
  • for processing of your job application; and
  • for generating statistical insights regarding the usage of our websites, so as to analyze and/or improve these websites.

We process your personal data on the basis of one or more of the following legal bases:

  • execution of an agreement;
  • compliance with statutory obligations;
  • legitimate interest; and
  • your consent.

Data retention period

Fermm does not store your data for a longer period than required to fulfill the purposes set forth in this Privacy Statement and/or comply with legislation.

Sharing of data

For the purposes set forth in this Privacy Statement, Fermm might share your personal data with (other) entities directly related to Fermm.

In some instances, we might share your personal data with third parties, including, but not limited to:

  • third parties relevant to legal services we provide, such as counterparties, local attorneys, courts of law, bailiffs, regulatory institutions, and governmental institutions;
  • third parties, such as supervisory and other institutions, relevant to the compliance with statutory obligations; and
  • external suppliers relevant to the collection and processing of personal data for the purposes as set forth in this Privacy Statement, such as IT suppliers (time tracking and/or data management system providers), providers of communication services, and other suppliers to whom we outsource certain supportive services and activities.

 

The sharing of your personal data with the aforementioned third parties solely occurs for the purposes and on the legal bases as set forth in this Privacy Statement.

Third parties with whom we share personal data are individually responsible for complying with the applicable privacy legislation. Fermm accepts neither responsibility nor liability for the processing of personal data by these third parties. To the extent that a third party processes your data in the capacity of data processor of Fermm, Fermm shall enter into an agreement with that third party. Any such agreement will be in accordance with the requirements as set forth in the GDPR.

In order to enable us to provide our services, we might be prompted to share your personal data with a party established outside the European Economic Area. In such instances, Fermm will ensure that any such sharing will occur in accordance with the applicable privacy legislation.

Protection

Fermm has taken adequate technical and organizational measures to protect your personal data against unauthorized or unlawful processing as well as loss, destruction, alteration, or publication. Your rights

As a data subject, you have certain rights within the boundaries of our duties of confidentiality as lawyers. These rights include:

  • the right of access to your personal data. This right entails that you have the ability to make a request for insight into the personal data that we have collected from you. In making such a request, you should be aware that there are certain circumstances under which we are authorized to refuse to comply with your request, on the basis of our professional right to non-disclosure;
  • the right to rectification of your personal data, should they be incorrect or incomplete;
  • the right to erasure of your personal data. With regards to this right, you should be aware that there are certain circumstances under which we are legally obligated to retain your data to comply with our statutory obligations;
  • the right to restrict or object to processing of your personal data. With regards to this right, you should be aware that there are certain circumstances under which we are authorized to refuse to comply with your request, on the basis of our professional right to non-disclosure;
  • the right to data portability. This right entails the right to receive your personal data in a structured and common format. Additionally, you have the right to transfer these data to another party;
  • the right to not be evaluated based on automatic processing;
  • the right to file a complaint with the supervisory authority; and
  • the right to revoke consent. 

Should the rules and regulations of our professional group be at stake, we may first present your request, based on the aforementioned rights, for advice to the relevant local dean of the Netherlands Bar Association.

    Cookies

    Hippischadvocaat.nl and Fermm may use cookies on their websites. A cookie is a small text file that is saved by the web browser on your computer. You can block the use of cookies by adjusting your web browser’s settings. However, this may affect the functioning of our websites.

    Our websites do not employ the use of tracking or advertisement cookies. Personal data are, thus, not collected. The cookies we employ solely collect anonymized statistical data.
